The rules that govern access to and use of Examiar’s website, application and related services. If a signed customer order conflicts with this public page, the signed order controls for that customer.
1. Agreement and eligibility
These Terms form an agreement between Examiar and the individual or organisation using the service. By creating an account, accepting an order or using Examiar, you agree to these Terms. You must be at least 18 and able to enter a binding agreement. If you use Examiar for an organisation, you confirm that you can bind that organisation.
2. Accounts and organisation controls
Account information must be accurate and kept current. Users are responsible for protecting credentials and for activity performed through their accounts. Organisation owners and administrators control membership, roles and access to organisation content. Notify support@examiar.com promptly if an account may be compromised.
3. The service
Examiar provides tools for curriculum structures, topic management, reusable question banks, assessment patterns, exam papers, answer keys, imports and practice books. Features may evolve. We will use reasonable care to avoid changes that materially reduce a paid service without notice, but previews and early-stage features may change or be withdrawn.
4. Customer content and responsibilities
You retain ownership of content you submit. You grant Examiar a limited right to host, process, copy and display that content only as needed to provide, secure and improve the service. You are responsible for the accuracy, legality and permissions associated with your content, including copyright, assessment materials and any personal information.
Examiar does not guarantee the academic accuracy of imported, generated or user-authored questions. Qualified staff should review questions, answers, scoring and final exam papers before use.
5. Acceptable use
You must follow the Acceptable Use Policy. You may not misuse the service, interfere with its security, upload unlawful material, infringe rights, distribute malware, scrape at harmful scale or use Examiar to facilitate cheating or deceptive credentialing.
6. Fees, plans and taxes
Current prices are stated in US dollars unless an order says otherwise. Paid access is presently arranged through a written quote, invoice or order confirmation. The order identifies the plan, billing period, due date and any included services. Customers are responsible for applicable taxes, bank charges and currency-conversion costs unless the order states otherwise.
7. Cancellation and refunds
Cancellation, non-renewal and refund rules are described in the Refund and Cancellation Policy and any signed order. Mandatory consumer rights continue to apply where they cannot lawfully be excluded.
8. Privacy, confidentiality and data processing
Our Privacy Policy explains our handling of personal information. Each party must use reasonable care to protect the other party’s confidential information. The Data Processing Addendum applies when Examiar processes personal data for an organisation.
9. Suspension and termination
We may suspend access when reasonably necessary to address security threats, unlawful use, material breach or overdue undisputed fees. We will provide notice and an opportunity to resolve the issue when circumstances permit. Either party may terminate as stated in an order or these Terms. Customers should export needed content before termination. After termination, content is deleted or retained according to the Privacy Policy and applicable law.
10. Intellectual property and feedback
Examiar and its licensors own the service, software, design and branding. These Terms do not transfer those rights. If you provide feedback, you allow Examiar to use it without restriction or payment, provided we do not publicly identify you without permission.
11. Availability and warranties
We aim to provide a reliable service, but maintenance, failures and events outside reasonable control can cause interruptions. Except for express promises in an order and rights that cannot be excluded, the service is provided as available and without implied warranties of uninterrupted operation, fitness for a particular assessment decision or error-free output.
12. Liability
Neither party is liable for indirect, incidental, special or consequential loss, or for lost profit, revenue or data, to the extent permitted by law. Examiar’s aggregate liability relating to a paid service is limited to fees paid for that service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited, or to fraud, wilful misconduct or breach of confidentiality caused by a party.
13. Governing law and disputes
The parties should first try to resolve disputes in good faith through written notice. Unless an order states otherwise, these Terms are governed by the laws of Pakistan, without excluding mandatory protections that apply in a customer’s location. The courts of Pakistan have non-exclusive jurisdiction.
14. Changes and contact
We may update these Terms for legal, security or product reasons. Material changes will be communicated before they take effect when reasonably possible. Questions can be sent to support@examiar.com.
